The aim of this paper is to evaluate the extent of the practice of using informal payments for accessing the services of public clinics or hospitals across Europe and to explain the prevalence of this corrupt practice using the framework of institutional theory. To achieve this, a multi-level mixed-effect logistic regression on 25,744 interviews undertaken in 2020 with patients across 27 European Union countries is conducted. The finding is that the practice of making informal payments remains a prevalent practice, although (...) there are large disparities in the usage of this practice in different European countries. However, informal payments by patients are more likely when there is a lower institutional trust and a higher degree of asymmetry between formal and informal institutions. The resultant proposal is that policy makers need to address the institutional environment to tackle such informal payments. How this can be achieved is outlined. (shrink)

The coordination of beliefs, norms, and behaviors is foundational to theories of group formation. However, because beliefs and norms are not directly observable, signaling mechanisms are required to build reliable signals of latent traits. Although the mathematical theory behind these signals is robust, there is very little testing of ethnic marker theory or of its key propositions that markers become more prevalent along ethnic boundaries and where more than two cultural groups are in contact. We present an ethnographic test of (...) this theory with phonetic differences serving as potential group signals. The data derive from an ethnographic and linguistic investigation in two contrasting secondary school settings in Utah, one that is majority European American and one that is ethnically more diverse. Word list recordings were collected as part of interviews with teens from different backgrounds. We extracted acoustic data from the speech of European Americans (EAs) and Pacific Islanders (PIs), then analyzed differences in the pronunciation of the vowel in words such as “bit.” We found evidence of greater phonetic marking at the more diverse school, along more prominent boundaries of ethnic interaction. These results align with predictions made by the theoretical models. This initial empirical test of model predictions provides justification for the development of more complex models that could account for more variables within the environment. (shrink)

Human cooperation is highly unusual. We live in large groups composed mostly of non-relatives. Evolutionists have proposed a number of explanations for this pattern, including cultural group selection and extensions of more general processes such as reciprocity, kin selection, and multi-level selection acting on genes. Evolutionary processes are consilient; they affect several different empirical domains, such as patterns of behavior and the proximal drivers of that behavior. In this target article, we sketch the evidence from five domains that bear on (...) the explanatory adequacy of cultural group selection and competing hypotheses to explain human cooperation. Does cultural transmission constitute an inheritance system that can evolve in a Darwinian fashion? Are the norms that underpin institutions among the cultural traits so transmitted? Do we observe sufficient variation at the level of groups of considerable size for group selection to be a plausible process? Do human groups compete, and do success and failure in competition depend upon cultural variation? Do we observe adaptations for cooperation in humans that most plausibly arose by cultural group selection? If the answer to one of these questions is “no,” then we must look to other hypotheses. We present evidence, including quantitative evidence, that the answer to all of the questions is “yes” and argue that we must take the cultural group selection hypothesis seriously. If culturally transmitted systems of rules (institutions) that limit individual deviance organize cooperation in human societies, then it is not clear that any extant alternative to cultural group selection can be a complete explanation. Trait emotional intelligence (“trait EI”) concerns our perceptions of our emotional abilities, that is, how good we believe we are in terms of understanding, regulating, and expressing emotions in order to adapt to our environment and maintain well-being. In this article, we present succinct summaries of selected findings from research on (a) the location of trait EI in personality factor space, (b) the biological underpinnings of the construct, (c) indicative applications in the areas of clinical, health, social, educational, organizational, and (...) developmental psychology, and (d) trait EI training. Findings to date suggest that individual differences in trait EI are a consistent predictor of human behavior across the life span. (shrink)

The contribution have several aims. In addition to the discussion that follows variability of the concept of landscape and its relationship to the category of environment the contibution focuses on the specific problem of the current aesthetics: transformation of aesthetic reflection of the city as a whole, which is realized by the contemporary aesthetics and philosophy through the Kantian aesthetics in Critique of Aesthetics Judgement. Elaboration of opinions of Marie Rubene and Miroslav Marcelli leads us not only to summarize the (...) conclusions of recent theses, but further to reflect the transformation of city to a country, specific environment free from original effectiveness, where "human returns to natural and becomes a sort of huge subject, which is fluid in its inside..."). Animal data suggest that jet fuels such as JP-8 are associated with hearing deficits when combined with noise and that the effect is more pronounced than with noise exposure alone. Some studies suggest peripheral dysfunction while others suggest central auditory dysfunction. Human data are limited in this regard. The aim of this study was to investigate the possible chronic adverse effects of JP-8 combined with noise exposure on the peripheral and central auditory systems in humans. Fifty-seven participants who were current (...) personnel from the Royal Australian Air Force were selected. Based on their levels of exposure to jet fuels, participants were divided into three exposure groups. Groups were also categorised based on their noise exposure levels. All participants were evaluated by tympanometry, pure-tone audiometry, distortion product otoacoustic emissions, auditory brainstem response, words-in-noise, compressed speech, dichotic digit test, pitch pattern sequence test, duration pattern sequence test and adaptive test of temporal resolution. All auditory tests were carried out after the participants were away from the Air Force base for a minimum of two weeks, thus two weeks without jet fuel and noise exposure. Jet fuel exposure was significantly associated with hearing thresholds at 4 and 8 kHz; average hearing thresholds across frequencies in the better ear; DPOAEs at 2.8, 4 and 6 kHz; ABR wave V latency in the right ear; compressed speech and words-in-noise. Further analyses revealed that participants with low exposure level to jet fuels showed significantly better results for the aforementioned procedures than participants with moderate and high exposure levels. All results were controlled for the covariates of age and noise exposure levels. The results suggest that jet fuel exposure, when combined with noise exposure, has an adverse effect on audibility in humans. Taking all the test results into consideration, jet fuel exposure combined with noise exposure specifically seems to affect the peripheral hearing system in humans. (shrink)

The article “The EU Top Court Rules that Married Same-Sex Couples Can Move Freely Between EU Member States as “Spouses”: Case C-673/16, Relu Adrian Coman, Robert Clabourn Hamilton, Asociaţia Accept v Inspectoratul General pentru Imigrări, Ministerul Afacerilor Interne”, written by “Alina Tryfonidou” was originally published electronically on the publisher’s internet portal on 23 April 2019 without open access.

In the Coman case, the European Court of Justice was asked whether the term “spouse”—for the purposes of EU law—includes the same-sex spouse of an EU citizen who has moved between EU Member States. The ECJ answered this question affirmatively, holding that a refusal to recognise a same-sex marriage and the resultant refusal to grant family reunification rights to a Union citizen who moves to another Member State, would constitute an unjustified restriction on the right to free movement that Union (...) citizens enjoy under EU law. This case comment analyses the judgment, arguing that the Court’s pronouncement is a very welcome first step towards marriage equality at a cross-border level in the EU. At the same time, following the delivery of this ruling, a lot of questions have arisen and gaps in the protection of same-sex couples persist, and these are also analysed in this piece. (shrink)

Thought experiments have played a pivotal role in many debates within ethics—and in particular within applied ethics—over the past 30 years. Nonetheless, despite their having become a commonly used philosophical tool, there is something odd about the extensive reliance upon thought experiments in areas of philosophy, such as applied ethics, that are so obviously oriented towards practical life. Herein I provide a moderate defence of their use in applied philosophy against those three objections. I do not defend all possible uses (...) of thought experiments but suggest that we should distinguish between legitimate and illegitimate uses. Their legitimate uses are determined not so much by the modal content of any actual thought experiment itself, but by the extent to which the argument in which it is nested follows basic tenets of informal logic and respects the fundamental contingency of applied ethical problems. In pursuing these ideas, I do not so much provide a set of criteria for their legitimate use, but more modestly present two significant ways in which their use can go awry. (shrink)

The recent literature on Nāgārjuna’s catuṣkoṭi centres around Jay Garfield’s and Graham Priest’s interpretation. It is an open discussion to what extent their interpretation is an adequate model of the logic for the catuskoti, and the Mūla-madhyamaka-kārikā. Priest and Garfield try to make sense of the contradictions within the catuskoti by appeal to a series of lattices – orderings of truth-values, supposed to model the path to enlightenment. They use Anderson & Belnaps's framework of First Degree Entailment. Cotnoir has argued (...) that the lattices of Priest and Garfield cannot ground the logic of the catuskoti. The concern is simple: on the one hand, FDE brings with it the failure of classical principles such as modus ponens. On the other hand, we frequently encounter Nāgārjuna using classical principles in other arguments in the MMK. There is a problem of validity. If FDE is Nāgārjuna’s logic of choice, he is facing what is commonly called the classical recapture problem: how to make sense of cases where classical principles like modus pones are valid? One cannot just add principles like modus pones as assumptions, because in the background paraconsistent logic this does not rule out their negations. In this essay, I shall explore and critically evaluate Cotnoir’s proposal. In detail, I shall reveal that his framework suffers collapse of the kotis. Taking Cotnoir’s concerns seriously, I shall suggest a formulation of the catuskoti in classical Boolean Algebra, extended by the notion of an external negation as an illocutionary act. I will focus on purely formal considerations, leaving doctrinal matters to the scholarly discourse – as far as this is possible. (shrink)

The purpose of this discussion is twofold. First, I want to shed some light on Kant's concept of personhood as rational agency, by situating it in the context of the first Critique's conception of the self as defined by its rational dispositions. I hope to suggest that this concept of personhood cannot be simply grafted onto an essentially Humean conception of the self that is inherently inimical to it, as I believe Rawls, Gewirth, and others have tried to do. Instead (...) I will try to show how deeply embedded this concept of personhood is in Kant's conception of the self as rationally unified consciousness. Second, I want to deploy this embedded concept of personhood as the basis for an analysis of the phenomenon of xenophobia. (shrink)

Immanuel Kant is one of Alain Badiou’s principle philosophical enemies. Kant’s critical philosophy is anathema to Badiou not only because of the latter’s openly aired hatred of the motif of finitude so omnipresent in post-Kantian European intellectual traditions—Badiou blames Kant for inventing this motif—but also because of its idealism. For Badiou-the-materialist, as for any serious philosophical materialist writing in Kant’s wake, transcendental idealism must be dismantled and overcome. In his most recent works, Badiou attempts to invent a non-Kantian notion of (...) the transcendental, a notion compatible with the basic tenets of materialism. However, from 1988’s Being and Event up through the present, Badiou’s oeuvre contains indications that he hasn’t managed fully to purge the traces of Kantian transcendental idealism that arguably continue to haunt his system—with these traces clustering around a concept Badiou christens “counting-for-one”. The result is that, in the end, Kant’s shadow still falls over Badiouian philosophy—this is despite Badiou’s admirable, sophisticated, and instructive attempts to step out from under it—thus calling into question this philosophy’s self-proclaimed status as materialist through and through. Public interest in the legacy of Russian religious philosophy, and above all in the legacy of V. S. Solovyov, reached its peak at the turn of the 1990s, after which it declined. As indirect evidence of this, we can note the remaining unrealized idea of installing a monument to the philosopher, slowing down the pace of work on the release of a complete collection of his works, and reducing the number of works dedicated to him. The year of the centenary (...) since the death of Solovyov was symptomatic, when the authoritative representatives of the Russian philosophical community, S.S. Khoruzhiy and P.P. Gaidenko made an ambiguous assessment of Solovyov's ideological heritage and its significance for the subsequent development of Russian socio-philosophical and religious-theological thought. In the article the statement that the genealogy of the critical interpretation of Solovyov's legacy goes back to the works of the philosopher and theologian G.V. Florovsky is substantiated. Florovsky influence in Russian studies, as well as in post-Soviet Russia in general is difficult to overestimate. In this regard, the author draws attention to the ideological evolution of Florovsky, which gives the key to his interpretation of Solovyov's philosophy. The analysis showed that Florovsky's critical reinterpretation of Solovyov's legacy had both a theoretical, theological, and doctrinal character, and was caused by certain socio-psychological factors related to the generational conflict between representatives and heirs of the Russian religious and philosophical Renaissance of the early XX century. It is demonstrated that the reception of Solovyov by Florovsky was very significant, influential and archetypal for Russian religious and philosophical thought, both in Russia and abroad. (shrink)

We will focus on the theory of complete concept in the philosophy of Leib-niz. We will not emphasise the epistemological aspects, but rather will concentrate on the metaphysical implications of this theory. Some questions requiring an answer will be: are there two individual substances of the same kind? What is the nature of a substance that is only possible? What kind of notion has the unactualised possible? What is the nature of the relationship between individual substance and the complete no-tion? (...) In order to answer these questions, we will present in the first part of the paper the concept of individual substance, in the second part, we will focus on the problem whether the possible objects have or have not a complete concept, and in the third part we will give some additional arguments to support our answer. I wish to defend the claim that given the content and structure of any moral theory we are likely to find palatable, there is no way of uniquely breaking down that theory into either consequentialist or deontological elements. Indeed, once we examine the actual structure of any such theory more closely, we see that it can be classified in either way arbitrarily. Hence if we ignore the metaethical pronouncements often made by adherents of the consequentialist-deontological distinction, we are quickly led (...) to the conclusion that this distinction contributes nothing of consequence to an understanding of moral theory. I will try to show that there are basically two reasons for this. First, what we mean by the terms endemic to the consequentialist-deontological distinction have no unique references to particular states of affairs in actual cases of moral decision making. Hence we may justify any such concrete moral decision by reference to typically consequentialist or deontological reasoning indifferently. Second, scrutiny of actual and viable moral theories reveals a much finer-grained structure than the consequentialist-deontological taxonomy can capture. And it is this structure, rather than simple attention to consequences or principles, that determines practical moral decision making. We would thus do better to develop the richer vocabulary of causes and constituents, goals and effects, states and events (mental, social, or physical). So in the end, the consequentialist-deontological distinction is irrelevant at the normative level of actual moral reasoning, whereas at the metaethical level it crudely schematizes two opposing types of dummy theory, neither of which is convincing, upon reflection, to any practicing moral philosopher. This paper provides an overview of results from an Australian Research Council-funded project "Sentiments and Risks: The Changing Nature of Human-Animal Relations in Australia." The data discussed come from a survey of 2000 representative Australians at the capital city, state, and rural regional level. It provides both a snapshot of the state of involvement of Australians with nonhuman animals and their views on critical issues: ethics, rights, animals as food, risk from animals, native versus introduced animals, hunting, fishing, and companionate (...) relations with animals. Its data point to key trends and change. The changing position of animals in Australian society is critical to understand, given its historic export markets in meat and livestock, emerging tourism industry with its strong wildlife focus, native animals' place in discourses of nation, and the centrality of animal foods in the national diet. New anxieties about risk from animal-sourced foods and the endangerment of native animals from development and introduced species, together with tensions between animals' rights and the privileging of native species, contribute to the growth of a strongly contested animal politics in Australia. © 2007 Brill Academic Publishers.
